Terms and Conditions for Weird Ball Pool

1. Acceptance of Terms

By downloading, installing, or using Weird Ball Pool (“the App”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, please stop using the App immediately.

2. License and Restrictions

2.1. License Grant: We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

2.2. Restrictions: You agree not to:

• Reverse-engineer or otherwise misuse the App’s code or services.

• Use the App for illegal or unauthorized purposes.

• Disrupt the App’s operation or servers (e.g., via hacking or malware).

• Violate any third party’s rights (including intellectual property or privacy rights).

3. User Accounts

3.1. Firebase Authentication: The App may require you to sign in using Firebase Authentication. You must provide accurate, up-to-date information.

3.2. Account Security: You are responsible for safeguarding your login credentials. We are not liable for unauthorized access resulting from your failure to secure your account.

4. Data Storage and Privacy

• Cloud Firestore: Game progress and related user data are stored on servers located in the United States. By using the App, you consent to the transfer of your data to these servers.

• Privacy Policy: Our Privacy Policy governs how we handle your information. By using the App, you consent to the data practices described therein.

5. Advertisements and Third-Party Services

1. Google AdMob & Unity Ads: The App uses these ad networks to serve ads. Any interaction with ads is solely between you and the advertiser.

2. Third-Party Links: The App may contain links to third-party websites or services. We do not control and are not responsible for their content, privacy policies, or practices.

3. No Endorsement: The presence of third-party services or ads does not constitute endorsement or responsibility for the content by HSK Software Inc..

6. Intellectual Property

All content, features, and functionality in the App (including text, images, graphics, logos, and software) are owned by HSK Software Inc. or our licensors and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

7. Disclaimer of Warranties

The App is provided “as is” and “as available,” without warranty of any kind. HSK Software Inc. disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted, secure, or error-free operation of the App.

8. Limitation of Liability

To the fullest extent permitted by law, HSK Software Inc. and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, data loss, or personal injury arising out of your use (or inability to use) the App.

9. Indemnification

You agree to indemnify and hold HSK Software Inc., its affiliates, officers, directors, employees, and agents harmless from and against all claims, damages, liabilities, losses, or expenses (including legal fees) arising out of or related to:

• Your use of the App,

• Your violation of these Terms,

• Your violation of any third-party right (including intellectual property, privacy, or other rights).

10. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including your breach of these Terms. Upon termination, your license to use the App will cease immediately, and we may delete your data from our systems.

11. Governing Law and Dispute Resolution

These Terms will be governed by and construed under the laws of British Columbia, Canada, without regard to conflict-of-law principles. Any disputes arising from or relating to these Terms or your use of the App will be exclusively resolved in the courts of British Columbia, Canada.

12. Changes to These Terms

We may update these Terms at any time. When we do, we will post the revised version within the App or by other means. Your continued use of the App after changes become effective constitutes your acceptance of those changes.
